🚫 Inflexible no-fly zones

The designation of "red zones" and overly strict no-fly zones has paralyzed operations in many provinces, from border areas to the regions around airports that cover entire cities. This directly impacts natural disaster surveillance and livelihoods.

  • Buriram: Officials "feel like the blind" as they are unable to use drones for monitoring wild elephants.
  • Chiang Mai: The no-fly zone around the airport covers almost the entire city.
  • Chanthaburi: Declared a red zone, affecting durian orchards and economic fruit crops.

The complicated process that takes 3-5 days, coupled with an unstable application, causes users to miss urgent job opportunities that are critical for income. This creates uncertainty, leading customers to turn to alternative options.

Farmers are the most severely affected. The suspension of flights prevents timely pesticide and fertilizer spraying, resulting in significant crop damage, losses, and a direct impact on food security.

In the meeting with the drone volunteer committee, various opinions and issues were presented based on the provinces of the participants as follows:

Phitsanulok

  • Pramechaw: Facing the issue of no-fly zones.
  • Anurak (Photographer/Studio): Land survey photography, wedding shoots, buildings, and industrial factory work were canceled for 2-3 jobs due to waiting for permission for 3-5 days, causing two drones to be left idle.

Buriram

  • Natthaphon (Fixed-wing Survey/Elephant Monitoring): Facing the issue of no-fly zones in border areas, which are "red zones" (war zones/security areas), causing wildlife reserve officers to hesitate using drones for monitoring wild elephants that have come out into communities. It has become like being "blind," unable to assess the situation and utilize human resources properly. The project had to shift to other provinces where drone use is allowed.

Bangkok

  • Phattha (Tun) (Production/Survey): Lost jobs as clients switched to using cranes instead of drones due to uncertainty about whether flight bans will continue. Almost all work in August was lost. Additionally, the UAS Portal system allows flights only for Visual Line of Sight (VLOS), but I am doing survey work that requires Beyond Visual Line of Sight (BVLOS), making it impossible to submit a permission request.
  • Nan (Legal Expert): I have to carry the updated announcement to explain the legal details to the police officers in Bangkok when I need to file a daily record to request flight permission.

Ratchaburi

  • Praphat (Solar Survey): Encountered issues with the application (UAS Portal) being unstable. On the first day, permission was granted, but the next day, permission could not be obtained for the same area. Flight at Kamphaeng Saen (VTD16) was approved by the Air Force, but the application did not authorize it, causing a conflict, and I was unable to contact the CAAT officers at all.
  • Nan added: The VTD16 area affects three provinces, but the announcement only specifies Ratchaburi, causing nearby provinces to be denied because they are near security zones.

Nonthaburi

  • Phet (Freelance Production/Ads/Movie): The flight permission process takes 3 days, causing missed opportunities for urgent jobs that contacted us in the evening for a flight the next morning. I suggest making it easier to approve flights for altitudes below 50 meters. After the flight ban, the client lost confidence and switched to using cranes instead.

Chiang Mai.

  • Kamolwat (University): The drone training program for students and alumni was canceled because the university adhered to a delayed provincial announcement (signed on August 8 but received on August 15), which was an outdated version prohibiting flights nationwide, despite a new announcement from the regulatory authorities. It is believed that the regulators have "disadvantages" rather than "advantages," so they focus on safety and do not approve requests urgently.
  • Thanaphat (Agricultural Drone VTD42): As a farmer and drone operator, I was impacted with a 100% loss of income for half of the month. The aviation authority issued a flight unlock announcement on August 16-17, but allowed flights only until August 31. The impact is that loans do not wait. Sweet corn was damaged by worms and the factory refused to purchase it, so it had to be sold as animal feed at a low price (1 baht per kilogram). The 3-day flight approval process was too slow, as the worms and pests didn’t wait. I needed to fly across several districts and survey areas to create maps in the app twice a day for small plots (3 rai per plot), which was not feasible. I suggest that agricultural drones be classified as agricultural tools, similar to tractors.
  • Thanasith (Freelancer): I have been flying for 6 years and have faced the issue of no-fly zones near Chiang Mai airport, which covers almost the entire city. This has made work difficult and requires relying on multiple agencies to obtain permission.

Kalasin

  • Mark (Kwee Wong) (Agricultural Drone T16-T20): The damage is not limited to pilots losing income, but farmers are also facing damage to their crops. For example, rice has been damaged by more than 30% (from 5,000 baht/rai to 3,000 baht/rai) due to not being sprayed with disease-preventing chemicals during the seedling stage. Fertilizer is expensive, and there is a shortage of people to spread pesticides. Contractors who spray pesticides are rare because many have died from direct exposure to chemicals. This has made agricultural drones 100% necessary.

Khon Kaen

  • Pongpich (Lawyer/Commissioner of the Civil Aviation Commission): I once used drones to survey flooding and presented political matters in parliament 3-4 years ago without permission, as I needed urgent information to address public issues. I used drones in asset tracing for enforcement work when I was not granted permission to enter the area. My house is located behind the airport, so I would fly during floods without considering the airport, as I knew the times when planes took off and landed. I found the application process cumbersome, so I chose not to register and flew when necessary.

Uthai Thani

  • Kosol (Sells Sweets/Land Survey Photography): I was impacted for 17 days, unable to take land survey jobs, which I typically get 2-3 clients per day, earning around 1,000 baht per client.

Chanthaburi

  • Kritsadanon Rattanapun (Facebook Comment): Chanthaburi, a major durian-producing province and an important economic fruit region, has been designated as a no-fly zone due to its classification as a red zone, even in some districts not bordering the border. The shortage of foreign labor, who have returned to their countries, has led farmers to turn to drones for spraying fertilizers on durian during the critical food accumulation period for flowering. I suggest considering exceptions for agricultural drone use in districts that are not near the border, as drones are large, fly at low altitudes, and have short battery life, posing no threat to national security.
  • Nan (Legal Expert): She stated that officials in the Chanthaburi and Trat zones fly drones every day to drive away wild elephants, even though it is a no-fly zone under BTB 36. Coordination is carried out internally with the army and navy.

Nakhon Sawan, Phichit, Phetchabun

  • Nutty Mju (Facebook Comment): Inquired whether the no-fly zones in these provinces are still strictly prohibited or if flying is allowed under certain conditions.

Sa Kaeo

  • Sarayut TheTew Chotprom (Facebook Comment): Found that using drones for inspecting sugarcane plantations at factories is challenging.

This has a significant impact on livelihoods and the economy across various sectors. There have been calls for improving the laws and the operations of relevant agencies to make them more appropriate and efficient.

- Petch (Production).: Requested permission for 3 days, but received an urgent job in the evening. Could not fly the next morning in time, causing a missed opportunity.

- คุณพัทระ (ตูน): Lost work for the entire month as clients switched to using cranes due to uncertainty about the regulations.

The UAS Portal app is unstable. ▶

- Conflict: The app grants permission, but the site prohibits flight, or local authorities allow it, but the app does not.

- Confusion: Initially, the app approved immediately, but later it did not approve, and there was confusion regarding drawing a 150–200 meter circle.

- Limitations: Only supports VLOS (Visual Line of Sight) flights, which causes issues for BVLOS (Beyond Visual Line of Sight) survey work.

Lack of coordination between agencies. ▶

-Thanakorn (Office of the Auditor General): Local police do not understand the regulations and prohibit flights even with the documentation.

  • แยกประเภทโดรนเกษตรออกจากโดรนถ่ายภาพ/สำรวจ: เนื่องจากวัตถุประสงค์การใช้งาน, เพดานบิน (3-5 เมตร, สูงสุด 10-30 เมตร), ระยะการบิน (ไม่เกิน 1 กม.) และระยะเวลาการทำงาน (แบตเตอรี่บินได้ 10 กว่านาที) แตกต่างกันอย่างชัดเจน ควรให้โดรนเกษตรถือเป็น "เครื่องมือเกษตร" และอนุญาตให้บินได้โดยเพียงแค่แจ้งให้หน่วยงานทราบและมีใบอนุญาตนักบินที่ถูกต้อง
  • ปรับปรุงกระบวนการขออนุญาตให้รวดเร็วและสะดวกขึ้น:
    • เสนอให้มีการอนุมัติทันทีใน 30 วินาที แบบระบบ LANCC ของอเมริกา
    • เสนอให้แค่ลงทะเบียนและแจ้งข้อมูลการบินไว้เป็นหลักฐานเพื่อตรวจสอบย้อนหลัง ไม่ต้องรอการอนุมัติ
    • เสนอให้เพิ่มเพดานบินที่ไม่ต้องขออนุมัติเป็นพิเศษ (เช่น 50 เมตร หรือ 90 เมตรในพื้นที่ VTD)
    • พัฒนาแอปพลิเคชันให้เสถียรและใช้งานง่าย
  • เพิ่มความรู้ความเข้าใจให้เจ้าหน้าที่ท้องถิ่น: CAAT ควรประสานงานกับหน่วยงานปกครองส่วนท้องถิ่น (อำเภอ, กำนัน, ผู้ใหญ่บ้าน) เพื่อให้มีความเข้าใจที่ถูกต้องเกี่ยวกับกฎระเบียบโดรนเกษตร

ปัญหาหลักที่พบ:

  • เขตห้ามบิน (พื้นที่สีแดง): กระทบการเฝ้าระวังช้างป่าและป้องกันพืชผล
  • ผลผลิตเสียหายหนัก: ศัตรูพืชระบาด (หนอน, เพลี้ย) เพราะพ่นยาไม่ทันการณ์
  • ขั้นตอนขออนุญาต: ล่าช้า (3–7 วัน), แอปฯ ไม่เสถียร
  • ผลกระทบเศรษฐกิจ: ขาดรายได้ 100%, ต้นทุนพุ่งสูง
  • ปัญหาประกันภัย: ต้นทุนสูง, เคลมยาก, ไม่ครอบคลุม

ปัญหาหลักที่พบ:

  • ความไม่เข้าใจของตำรวจท้องที่: แม้มีเอกสารถูกต้อง ก็ยังถูกห้ามบิน
  • ขาดการสื่อสารนโยบาย: ความรู้จากส่วนกลางไม่ถึงระดับปฏิบัติการ

การประชุมครั้งนี้ได้รวบรวมผู้ใช้งานโดรนจากหลากหลายสาขาอาชีพ เพื่อสะท้อนถึงปัญหา อุปสรรค ผลกระทบ และข้อเสนอแนะเกี่ยวกับกฎระเบียบการบินโดรนในประเทศไทย โดยเนื้อหาถูกแบ่งตามสาขาอาชีพเพื่อให้เห็นประเด็นที่ชัดเจนยิ่งขึ้น

1. เกษตรกร / นักบินโดรนเกษตร

ผู้เข้าร่วม

  • ณัฐพล (บุรีรัมย์) – ใช้โดรน Fixed-wing สำรวจและเฝ้าระวังช้างป่าในเขตรักษาพันธุ์สัตว์ป่าติดชายแดน ใช้โดรนติดกล้องเทอร์มอลบินกลางคืนเพื่อประเมินจำนวนช้างและกำลังคนในการไล่ช้าง
  • ธนพัฒน์ (เชียงใหม่) – เกษตรกรและผู้รับจ้างบินโดรน ใช้โดรนหลายอำเภอในการพ่นยาข้าวโพดหวาน (VTD42) และข้าว
  • มาร์ค/กวีวงศ์ (กาฬสินธุ์) – นักบินโดรนเกษตรมากว่า 5 ปี ใช้รุ่น T16–T20 และต้องใช้โดรน 100% แทนแรงงานคน เนื่องจากผู้รับจ้างพ่นยาส่วนใหญ่เสียชีวิตจากสารเคมี

ปัญหาที่พบ

  • เขตห้ามบินและความมั่นคง: เขตชายแดน (เช่น อ.ดนแดง) ถูกระบุ “พื้นที่สีแดง” แม้เจ้าหน้าที่ได้รับอนุญาตและลงทะเบียนแล้ว แต่ไม่สามารถบินได้ → เท่ากับ “คนตาบอด” ไม่รู้จำนวนช้างที่ออกจากป่าและเสี่ยงเข้าใกล้ชุมชน
  • ผลกระทบต่อผลผลิต: การงดบินทำให้พืชผลเสียหายอย่างหนัก เช่น ข้าวโพดหวานถูกหนอนเจาะ จนต้องขายเป็นอาหารสัตว์ราคาถูก (1 บาท/กก.) ข้าวเมื่อถูกเพลี้ย หากไม่ฉีดยาภายใน 1–2 วัน จะเสียหายทั้งแปลง
  • กระบวนการขออนุญาต: ใช้เวลา 3–7 วัน ไม่สอดคล้องกับสถานการณ์จริง แอปฯ UAS Portal ไม่เสถียร ขอได้วันแรก วันถัดไปขอไม่ได้ / แอปฯ อนุญาตแต่หน้างานไม่อนุญาต และการวาดวงกลม 150–200 ม. มีความสับสน
  • ความไม่สะดวกของพื้นที่ภาคเหนือ: แปลงเล็ก (3–4 ไร่) ต้องบินหลายแปลงต่อวัน ทำให้การยื่นขออนุญาตล่วงหน้าไม่สอดคล้องกับงานจริง

ผลกระทบทางเศรษฐกิจ

  • นักบินเกษตรขาดรายได้ 100% ช่วงงดบิน
  • เกษตรกรเสียหายมากกว่า 30% ข้าวเสียหายเฉลี่ย 5,000 บาท/ไร่
  • ต้นทุนปุ๋ยสูงขึ้น แต่รายได้หด
  • สถาบันการเงิน/ไฟแนนซ์ไม่มีมาตรการช่วยเหลือ
  • หลายคนลดต้นทุนฤดูกาลถัดไป เช่น เลิกจ้างโดรน หรือหว่านข้าวแล้วปล่อยตามธรรมชาติ

การประกันภัย

  • บังคับทำประกันภัยบุคคลที่สาม 2 ล้านบาทสำหรับโดรน > 25 กก.
  • บริษัทบางแห่งเลิกเคลมซ่อมโดรน เพราะจำนวนเคลมสูง ปัจจุบันเหลือแต่ประกันบุคคลที่สาม
  • ค่าความเสียหายส่วนแรก (Excess) ≈ 10% หรือ 3,000–7,000 บาท
  • หากปิดเรดาร์ = จงใจ → ประกันไม่จ่าย

ข้อเสนอแนะ

  • แยกโดรนเกษตรออกจากโดรนถ่ายภาพ/สำรวจ
  • กำหนดให้เป็น “เครื่องมือการเกษตร” เพียงแค่ยื่นแจ้ง ไม่ต้องขออนุญาตซับซ้อน
  • ปรับขั้นตอนอนุญาตให้ง่ายและรวดเร็วขึ้น
  • ฝึกความเข้าใจกับเจ้าหน้าที่ปกครองท้องที่
  • อนุโลมให้บินได้ในพื้นที่ไม่ติดชายแดน แม้อยู่ในโซนสีแดง เช่น จันทบุรี (แหล่งทุเรียนส่งออก)

2. นักบินโดรนเพื่อการถ่ายภาพ / โปรดักชัน / สำรวจ

ผู้เข้าร่วม

  • พัทธระ/ตูน (กรุงเทพฯ) – โปรดักชัน งานโฆษณา ภาพยนตร์ ละคร และงานสำรวจไซต์
  • เพชร (นนทบุรี) – ฟรีแลนซ์โปรดักชัน
  • อนุรักษ์ (พิษณุโลก) – ช่างภาพอิสระ ใช้โดรนถ่ายงานแต่ง/อาคาร/อุตสาหกรรม และแมปปิงที่ดิน
  • ธนสิทธิ์ (เชียงใหม่) – นักถ่ายภาพทางอากาศ > 6 ปี
  • โกศล – รับถ่ายภาพที่ดิน

ปัญหาที่พบ

  • งานหาย/ถูกยกเลิก: ลูกค้าเปลี่ยนไปใช้เครนแทน เนื่องจากไม่มั่นใจว่าจะห้ามบินต่อเนื่องหรือไม่
  • การขออนุญาตล่าช้า: บทบาทงานมักมาด่วน เช่น ลูกค้าติดต่อคืน → ต้องถ่ายเช้า แต่ขออนุญาตใช้เวลา 3 วัน
  • แอปฯ UAS Portal: ไม่รองรับ BVLOS, ต้องบิน VLOS เท่านั้น ระบบไม่เสถียร ปฏิเสธโดยไม่ชี้แจง
  • เขตห้ามบิน: กรุงเทพฯ ต้องอธิบายเจ้าหน้าที่เอง, เชียงใหม่ เขตห้ามบินกินพื้นที่เกือบทั้งเมือง
  • การบินกลางคืน: จำกัดเพียง 5 คืน/ต่อคน/เดือน → ไม่พอสำหรับโปรดักชัน

ผลกระทบ

  • ขาดรายได้, งานถูกยกเลิก
  • บางรายต้องคืนเงินมัดจำลูกค้า
  • ต้องแบกรับต้นทุนเอง

ข้อเสนอแนะ

  • ลดเวลาขออนุญาต ให้ยื่นแล้วบินได้เลย ตรวจสอบย้อนหลังได้
  • จำกัดเพดานบินใน VCD < 90 เมตร แทนห้ามทั้งหมด
  • รูปแบบต่างประเทศ: อนุมัติภายใน 5 นาที แต่มีค่าธรรมเนียม – นักบินยินดีจ่าย

การใช้งาน

ใช้โดรนตรวจสอบงานก่อสร้างรัฐ เช่น เขื่อน เพื่อดูการทุจริต ทำแผนที่ 3 มิติและวัดปริมาตร

Issue

ตำรวจท้องที่ไม่เข้าใจกฎ แม้เอกสารครบก็ห้ามบิน บ่อยครั้งต้องไปเคลียร์กับหัวหน้าสถานี

ผลกระทบ/ประโยชน์

โดรนช่วยตรวจพบโกงปริมาตรดินสูงถึง 80% ซึ่งเป็นหลักฐานเข้มแข็งกว่าการตรวจแบบดั้งเดิม

ไม่ได้รับผลกระทบช่วงงดบิน เพราะตรงกับปลายปีงบประมาณ

4. อาจารย์ / ผู้สอนโดรน

ข้อสังเกต

ผู้คุมกฎไม่ได้มีส่วนได้จากการใช้ แต่มีส่วนเสีย (ความรับผิดชอบ) → เลือกปฏิเสธหรือถ่วงเวลาเพื่อ “เล่นเซฟ”

5. พนักงานบริษัทเอกชน (สำรวจโซลาร์เซลล์)

ประพัฒน์ – ใช้โดรนถ่ายภาพโซลาร์

Issue

  • UAS Portal ไม่เสถียร ขอได้บ้าง ไม่ได้บ้าง
  • ข้อมูลกฎระเบียบจากหน่วยงานกลาง (กพท.) ขัดแย้งกับท้องถิ่น เช่น กองบินกำแพงแสน
  • ไม่สามารถติดต่อสายตรงกพท.ได้

6. ทนาย / ที่ปรึกษากฎหมาย

การใช้งาน

เคยใช้โดรนสำรวจน้ำท่วม ปัจจุบันใช้เพื่อสันทนาการและการสืบทรัพย์ในงานคดี

Issue

  • มองว่าการลงทะเบียนผ่านแอปฯ ยุ่งยากเกินไป
  • กรณีฉุกเฉิน เช่น น้ำท่วม → ต้องบินทันทีแม้ในเขตสนามบิน
  • ปัญหาเชิงโครงสร้าง เช่น เมืองขยายตัว การก่อสร้างขวางทางน้ำ

7. ผู้เชี่ยวชาญ / ที่ปรึกษา

คุณแนน – ผู้เชี่ยวชาญด้านกฎหมายโดรน

  • ผู้สร้างกฎ ≠ ผู้ใช้งานจริง → ก่อให้เกิดช่องว่างความเข้าใจ

  • ประเด็น “เศรษฐกิจปากท้อง vs. ความมั่นคง” → ความเห็นแบ่งฝ่าย
  • โดรนของเล่น (<1,000 บาท) อาจก่อความเสี่ยงมากกว่าโดรนเกษตร
  • ตัวอย่างจากต่างประเทศ เช่น LAANC (สหรัฐฯ) อนุมัติใน 30 วินาที พร้อม QR Code
  • ข้อมูลบิดเบือนในโซเชียล → เสี่ยงทำให้มีการงดบินอีกครั้ง

Summary

ผู้เข้าร่วมจากทุกสาขามีความเห็นตรงกันว่า กฎระเบียบการบินโดรนยังไม่สอดคล้องกับสภาพการใช้งานจริง โดยเฉพาะเรื่องความรวดเร็วในการขออนุญาต ความเสถียรของระบบ UAS Portal และการขาดความเข้าใจในบริบทแต่ละอาชีพ ส่งผลกระทบโดยตรงต่อเศรษฐกิจและรายได้ของประชาชน จึงมีข้อเสนอให้ แยกประเภทโดรนเกษตรออกจากโดรนสำรวจ/ถ่ายภาพ and ปรับกระบวนการขออนุญาตให้ง่ายและรวดเร็วยิ่งขึ้น เพื่อตอบสนองความต้องการที่เร่งด่วนจริงในภาคสนาม.
